FOUNDER'S OFFER WEBSITE PACKAGE

1. PACKAGE OVERVIEW

This agreement outlines the terms and conditions for the Founder's Offer Package offered by Bizzuppoter (https://bizzuppoter.com). The package includes a custom-designed, mobile-responsive website built on the Astro framework and hosted on Cloudflare Pages.

2. INCLUDED SERVICES

2.1 Core Design & Development

• 100% Original Custom Website Design built with Astro framework (no templates)
• Up to 8 Website Sections including Header, Footer, Hero, About, Contact, Testimonials, Work/Portfolio, and Services
• Mobile-Responsive Design optimized for all devices and screen sizes
• 40% Faster Loading Speed through Astro optimization
• Basic Favicon Creation (client must provide logo file)
• Basic Copywriting Services based on client-provided business details and information

2.2 Hosting & Domain Services

• FREE Domain Registration for first year (domain renewal becomes client's responsibility after year 1)
• FREE Cloudflare Pages Hosting (lifetime for static websites)
• SSL Certificate included via Cloudflare (automatic renewal)
• Domain Connection to Cloudflare Pages fully configured

2.3 Legal & Compliance Implementation

• Privacy Policy Page (client must provide legal content)
• Terms of Service Page (client must provide legal content)
• GDPR Cookie Consent Banner with basic implementation including:

• Customizable cookie consent banner design
• Essential cookies enabled by default
• Analytics cookies opt-in functionality
• Cookie policy page generation
• User consent preferences storage

2.4 Visual Assets & Design Elements

2.7 Complimentary Maintenance (12 Months)

Covered Services:

• Astro Framework updates (monthly security and performance updates)
• Dependency updates (npm packages and security patches)
• SSL Certificate renewal (automatic)
• Basic technical support via email

Maintenance Limitations:

• No design changes or layout modifications
• No new functionality additions
• Maintenance window: First week of each month
• Response time: 48 hours for support requests
• Additional changes beyond maintenance scope: $29/hour (minimum 1-hour billing)
• Extended maintenance after year 1: $29/month

3. STANDARD WEBSITE SECTIONS

The base package includes up to 8 sections. Standard sections include:

1. Header Section - Navigation menu, logo placement, main menu structure
2. Hero Section - Main banner, headline, call-to-action elements
3. About Section - Company or personal story, mission statement
4. Services Section - Service offerings, packages, descriptions
5. Work/Portfolio Section - Project examples, case studies, portfolio items
6. Testimonials Section - Customer reviews, social proof elements
7. Contact Section - Contact form, address, social media links
8. Footer Section - Navigation links, copyright information, additional details

Additional sections beyond 8 are available at $19 per section.

4. ADDITIONAL SERVICES & PRICING

All additional services require separate payment and are not included in the base package price:

Important: The 7-day delivery timeline applies only to the base package outlined in Section 2. Requesting any additional services listed below may extend the project timeline. A revised timeline will be mutually agreed upon based on the scope of the requested additions before work on those additions commences. Furthermore, certain services (e.g., Cloudflare Image Transformation, Advanced Form Systems using Cloudflare Workers) require the Client to add their own payment method to their Cloudflare account to cover potential usage-based fees charged directly by Cloudflare. Bizzuppoter cannot complete the implementation of these specific features until the Client has added their billing details. Bizzuppoter does not manage or have access to Client billing information.

5. IMAGE USAGE POLICY

5.1 Included Images

• Up to 10 open-source images are included in the base package at no additional charge
• Images sourced from Unsplash, Pexels, Pixabay, or similar royalty-free platforms

5.2 Additional Images

• Images beyond 10: Client pays Cloudflare image transformation setup fees directly
• Premium stock images: $29 for up to 10 licensed images from Shutterstock/Getty
• Image editing: $5 per image for professional editing and optimization
• Client-provided images: Used as-is with no editing included in base package

6. COPYWRITING SERVICES

6.1 Basic Copywriting (Included)

• Basic website copy created from client-provided business details
• Section headings and basic descriptions
• Call-to-action text
• Requirement: Client must provide comprehensive business information, key messages, and content guidelines

6.2 Advanced Copywriting ($99)

• Professional content writing and optimization
• SEO-optimized copy with keyword integration
• Persuasive sales copy and compelling narratives
• Brand voice development
• Extended content for all sections

7. CLIENT RESPONSIBILITIES

7.1 Content Provision

• All text content and business information must be provided by client
• Legal content for Privacy Policy and Terms of Service pages
• Business details, service descriptions, and company information
• Logo file (for favicon creation)
• High-resolution images (if client wishes to use own images)

7.2 Timely Communication

• Respond to requests for information within 48 hours
• Review and approve designs within agreed timeframes
• Provide feedback during revision round

7.3 Third-Party Service Costs

• Domain renewal after first year
• Any premium service subscriptions (forms, analytics, etc.)
• Payment gateway transaction fees
• Cloudflare usage fees for services beyond free tier

7.4 Account Security & Handover Responsibilities

• Upon handover of Cloudflare and GitHub account credentials (Day 7), Client is solely responsible for immediately securing these accounts by: (a) Changing the primary email address, (b) Changing the password to something strong and unique, and (c) Enabling their own Two-Factor Authentication (2FA). Bizzuppoter may provide guidance or tutorials (e.g., video, call) on this process, but the responsibility for execution and maintaining account security rests entirely with the Client.
• Client is responsible for creating a free Namecheap account (or using an existing one) to receive the domain registration transfer, which will be initiated by Bizzuppoter after the 60-day ICANN lock period (see Section 11.2).
• Client acknowledges they hold Super Administrator privileges on their Cloudflare account after handover and are responsible for managing users and billing settings.

8. PAYMENT TERMS

8.1 Payment Structure

• 100% payment required upfront via PayPal or bank transfer
• Content and assets must be submitted before project commencement
• Additional services billed separately before implementation

8.2 Refund Policy

• Refunds available only if project has not commenced
• Domain registration costs are non-refundable
• No refunds after project kickoff

8.3 Cancellation Policy

• Cancellation after project kickoff incurs 50% cancellation fee
• Fee covers invested time, resources, and committed costs
• Domain and hosting setup costs are non-refundable

9. DELIVERY PROCESS

9.1 Project Timeline

1. Day 0 (Timeline Start): Defined as the first business day *after* Bizzuppoter confirms receipt of BOTH: (a) Full payment, AND (b) All client-provided materials (content, logo, etc.) via the onboarding form. If Client provides their own domain: Day 0 additionally requires confirmation that Bizzuppoter has the necessary DNS control (e.g., domain pointed to Bizzuppoter's specified Cloudflare nameservers or necessary access granted).
2. Day 5: First draft delivered for client review
3. Day 6-7: Revision round completed (up to 5 changes)
4. Day 7: Final website deployed to Cloudflare Pages
5. Day 7: Handover of root login credentials for the client-dedicated Cloudflare and GitHub accounts.

9.2 Post-Launch Support

• 30-day launch support included for bug fixes and technical questions
• Email support for technical issues
• Does not include design changes or new features

10. REVISION & CHANGE POLICY

10.1 Included Revisions

• 1 revision round included with up to 5 changes across all sections
• Must be requested within 48 hours of initial draft delivery
• Changes must be clearly documented and specific

10.2 Additional Changes

• Additional revision rounds: $19 per round
• Post-launch changes beyond maintenance scope: $29/hour (minimum 1-hour billing)
• Extra sections beyond 8 included: $19 per section
• Scope changes or new functionality: Quoted separately based on requirements
• Major redesigns or restructuring: Requires new project agreement

11. OWNERSHIP & INTELLECTUAL PROPERTY

11.1 Account Handover (Day 7)

Upon project completion (Day 7), Bizzuppoter will deliver to the Client the root login credentials for:

1. Dedicated Cloudflare Pages Account (created by Bizzuppoter).
2. Dedicated GitHub Repository Account (created by Bizzuppoter).
3. Handover Package including:

• All login credentials
• Setup documentation
• Maintenance guidelines

Client is solely responsible for immediately securing these accounts as outlined in Section 7.4.

11.2 Domain Registration Transfer (Post 60 Days)

The domain name provided as part of the package is registered by Bizzuppoter on the Client's behalf via Namecheap. Due to ICANN's mandatory 60-day registrant transfer lock policy (an anti-fraud measure), the domain's ownership cannot be transferred for 60 days from the initial registration date. After 60 days, Bizzuppoter will initiate the domain "push" (internal transfer) to the Client's own Namecheap account.

• Client is responsible for creating a free Namecheap account (or using an existing one) to receive this transfer. Bizzuppoter will provide guidance on accepting the transfer.
• While Namecheap "pushes" are typically free, Client is responsible for any potential fees Namecheap might impose for accepting the domain transfer, although this is uncommon for internal pushes.
• Transfer to a Different Registrar: If the Client requests transfer to a registrar *other* than Namecheap, this requires a standard EPP code transfer process. Bizzuppoter will facilitate this but reserves the right to charge an administrative fee at the standard hourly rate (See Section 4) for the additional time required compared to a simple Namecheap push.

11.3 Agency Admin Access (Required for Maintenance)

• Client agrees that Bizzuppoter shall be invited to and retain specific, limited Administrator-level access to the Client's Cloudflare and GitHub accounts.
• Access Scope: This access grants necessary technical permissions for website management, updates, maintenance (Section 2.7), troubleshooting, and potential disaster recovery assistance. It **strictly excludes** access to sensitive areas like Client billing information, primary account settings managed by the Super Administrator (Client), or adding/removing other users.
  • Cloudflare Role: Administrator (Cannot manage Billing or Members).
  • GitHub Role: Admin collaborator (Limited to the specific website repository).
• This access is solely for the purpose of providing the 12-month complimentary maintenance and any future paid support services requested by the Client.
• Client may revoke Bizzuppoter's access at any time. However, doing so will prevent Bizzuppoter from providing the included maintenance services and any future technical support requiring such access.
• Post-Handover Liability: Once root credentials are handed over (Day 7), Bizzuppoter is not liable for issues arising from the Client changing credentials, misconfiguring security settings (including 2FA), accidentally deleting resources, or revoking Bizzuppoter's necessary admin access. Website recovery assistance may only be possible if Bizzuppoter retains the agreed-upon Admin access.

12. SERVICE LIMITATIONS

12.1 Excluded Services

The following are NOT included in the base package price:

• Unlimited revisions (only 1 round with 5 changes included)
• Content writing services (basic copywriting included based on client details; advanced copywriting available for $99)
• Ongoing maintenance beyond 12-month period
• Complex e-commerce functionality (basic e-commerce available as add-on)
• Phone support during development (email communication only)
• Project scope changes without additional fees
• Custom programming or advanced functionality
• Multi-language websites
• Database-driven features
• User authentication systems
• Premium third-party service subscriptions

12.2 Support Channels

• Email support only during development and maintenance
• Response time: 48 hours for maintenance requests
• Emergency support: Available through backup admin access (if retained)
• Phone support: Not available

13. THIRD-PARTY SERVICES

13.1 Free Tier Services

The following free services are included in base package:

• W3Forms free tier for contact forms
• Cloudflare Pages free hosting
• Cloudflare SSL certificates
• Google Analytics 4
• Google Search Console

13.2 Client-Paid Services

Client is responsible for direct payment of:

• Domain renewal after first year
• Premium form services (W3Forms Pro, Typeform subscriptions)
• Payment gateway transaction fees (Stripe, PayPal)
• Cloudflare usage beyond free tier
• Premium stock image licenses
• Any third-party premium service subscriptions

13.3 Setup vs. Ongoing Costs

• Bizzuppoter provides setup and integration only
• Ongoing service costs and subscriptions are client's responsibility
• We do not resell or markup third-party services

13.4 Changes to Third-Party Terms

• The availability and terms (including pricing) of third-party services (e.g., Cloudflare free tier, W3Forms free tier, Google services) are subject to change by the third-party providers themselves.
• Bizzuppoter is not responsible for any loss of service, required payments, or necessary website modifications resulting from changes in third-party service policies, features, or pricing structures after the website handover.

14. TECHNICAL SPECIFICATIONS

14.3 Performance Standards

• 40% faster loading speed compared to traditional frameworks
• Mobile-optimized performance
• Automated optimization through Astro framework

15. WARRANTY & LIABILITY

15.1 Service Warranty

• Website will be free from defects in workmanship for 30 days post-launch
• Technical functionality will work as specified in agreement
• Code will be clean, organized, and follow best practices

15.2 Limitation of Liability

• Bizzuppoter is not liable for client-provided content accuracy
• Not responsible for third-party service outages or changes (See also Section 13.4)
• Not liable for SEO rankings or traffic results
• Maximum liability limited to the total amount paid by the client for the package.
• Not liable for issues arising from Client's mismanagement of account security or revocation of necessary Agency Admin access post-handover (See Section 11.3).

15.3 Client Content Responsibility

• Client is solely responsible for accuracy and legality of provided content
• Client warrants they have rights to all provided materials
• Client indemnifies Bizzuppoter against copyright claims

15.4 Delivery Guarantee

Our 7-Day Delivery Guarantee entitles the client to a full refund of the package price paid (excluding non-refundable third-party costs like domain registration, approx. $15) *if* Bizzuppoter fails to deliver the first full website preview within the 7-day timeline defined in Section 9.1 (starting from Day 0). This guarantee is void if the client causes delays in providing feedback or requests scope changes during the initial 7-day build period.

16. TERMINATION & DISPUTE RESOLUTION

16.1 Termination Rights

• Either party may terminate before project commencement
• Bizzuppoter may terminate if client fails to provide required materials within 30 days
• Client may terminate with 50% cancellation fee after kickoff

16.2 Dispute Resolution

• Good faith negotiation required for all disputes
• Mediation before litigation
• Governing law: [Jurisdiction to be specified]

17. MODIFICATIONS TO TERMS

Bizzuppoter reserves the right to modify these terms and conditions. Changes apply to new projects only. Existing projects are governed by terms agreed upon at project initiation.

18. ACCEPTANCE OF TERMS

By making payment for the Founder's Offer Website Package, client acknowledges having read, understood, and agreed to these Terms & Conditions in their entirety.
